Constitutional Conventions - As introduced, establishes that general assembly appoints and recalls delegates to Article V convention; requires delegates to abide by instructions given to delegates by the general assembly

SB1432 is on The State and Local Government Calendar at 10:30 on Tuesday and I will be requesting permission to testify.

The push for an Article V Constitutional Convention is an issue that has waxed and waned for nearly 30 years.  Please check HERE. and scroll down for background.

Article V of the US Constitution:
The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

Regardless of what is being said, offered or proposed, the language above is the only direction we have. Even with the new language in SB1432, some of the questions remain unanswered.  If you read what the national supporters are writing, it contains words like, "we think", "we believe", etc.  With all due respect, they are making assumptions which really cannot be backed up with any part of what Article V states.  Article V is SILENT once CONGRESS calls the convention.

If the body that is so out of control now is put in charge of the Convention as Article V stipulates, would they even follow the directions in this bill?

The biggest question we have is this: If Congress is not following the Constitution now, what makes us think they would follow the Constitution if it is amended?  And....what would we be able to do about it?

Tennessee Eagle Forum will continue to oppose these proposals believing that we have a DISOBEDIENT CONGRESS not a DEFICIENT CONSTITUTION.

We need enforcement and adherence to our Constitution -- Defend, not amend.  We need federal legislators who are courageous and who will stand for constitutional rights and uphold their oath of office to defend, support and protect those rights.

Please urge our Senators to vote against this legislation.
